Public notice: intention to sell land at 345-347 Bell St, Bellfield

Banyule City Council gives notice of its intention to sell the Council owned land and improvements known as 345-347 Bell Street, Bellfield, being the land comprised in certificate of title volume 09361 folio 655. This proposal is made under section s.114 of the Local Government Act 2020 (Act).

Following the completion of the new Bellfield Hub, due in early 2022 and located at 230-232 Banksia Street, Bellfield (actual street address still to be confirmed), the activities of the Audrey Brooks Preschool will relocate to the new facility. The existing land and improvements will become surplus to Council’s requirements and are proposed to be sold.

Council’s Guidelines for the Sale and Exchange of Council Land and the Local Government Best Practice Guideline for the Sale, Exchange and Transfer of Land (2009) generally require any Council land to be sold on the basis of highest and best use.

At its meeting on 20 September 2021, Council resolved to commence statutory procedures to give public notice of its intention to sell the Land and undertake a community engagement process in accordance with its community engagement policy.


345-347 Bell Street

A person may make a written submission on the proposal.

Any person proposing to make a submission in accordance with Council’s Community Engagement Policy under section 55 of the Act must do so within 28 days of the publication of this notice.

All submissions will be considered in accordance with Council’s Community Engagement Policy and Plans.

Submissions will be considered in accordance with Council’s Community Engagement Policy and Plans at the Ordinary Meeting of Council on Monday 15 November 2021. Council will consider whether or not to sell the land at a subsequent meeting. If no submissions are received, Council may consider whether or not to sell the land at its ordinary meeting on Monday, 15 November 2021.

If you wish to be heard at the Council meeting in person, or to be represented by a person specified in the submission, you must state this in your written submission.

Please note that copies of submissions (including submitters’ names and addresses) will be made available at the Council meeting at which the above proposal will be considered. Council is also required to make any written submissions available for public inspection for a period of twelve months.
