WaterMarc Cafe - Notice of Intention to Lease

Banyule City Council gives notice under section 190(3) of the Local Government Act 1989 of its intention to enter into a lease with M & BT Investments Pty Ltd (ACN: 124 141 171) trading as The Healthlink Crew to operate the WaterMarc Café situated at 1 Flintoff Street, Greensborough.


The proposed Lease terms are as follows:

Lease Term:                        Five (5) years plus two (2) further terms of three (3) years  

Commencement Date:        9 November 2018 (or possible earlier commencement date to be determined)

Annual Lease rental:           $90,000 plus GST ($7,500 plus GST per month)

Annual Fixed Increase:       3.0 percent

The draft Lease can be viewed during normal business hours at Banyule City Council Service Centre, Level 3, 1 Flintoff Street, Greensborough.

A person has a right to make a submission to Council on the proposal in accordance with section 223 of the Act. 

Written submissions to Council quoting reference number F2017/2639 must be received by 5pm on Wednesday 29 August 2018 and should be addressed to the Chief Executive Officer, Banyule City Council and delivered to Level 3, 1 Flintoff Street, Greensborough or posted to PO Box 94, Greensborough 3088.

Submissions will be considered at the Ordinary Meeting of Council on Monday 17 September 2018 beginning at 7pm at 275 Upper Heidelberg Road, Ivanhoe. Council will consider whether or not to grant a lease at its meeting on 8 October 2018.

If you wish to be heard at the Council meeting in person, or be represented by a person specified in the submission, you must state this in your written submission.

If no submissions are received, Council may, at its Ordinary Meeting on Monday 17 September 2018, decide whether or not to enter into the lease.

Any person making a written submission under section 223 of the Act is advised that all submissions and personal information in the submission will be handled by Council in accordance with the provisions of the Privacy and Data Protection Act 2014.
