Proposed Discontinuance of Road Abutting 6 and 8 Elizabeth Grove Bundoora and Sale of Resultant Land

Banyule City Council (Council) gives notice of its intention to discontinue the section of road currently enclosed within the fence lines of 6 and 8 Elizabeth Grove, Bundoora, and sell the resultant land to the owners of those properties by private treaty. 

This proposal is made under section 189 and section 206 and Schedule 10 Clause 3 of the Local Government Act 1989 (“the Act”).

A plan identifying the ‘road’ proposed to be discontinued is shown below.

A person has a right to make a submission to Council on the proposal to discontinue the ‘road’ in accordance with section 223 of the Act. 

Written submissions to Council quoting reference No F2015/1251, must be received by 5.00pm on Wednesday 6 December 2017 and should be addressed to the Chief Executive Officer, Banyule City Council and delivered to 1 Flintoff Street, Greensborough or posted to PO Box 94, Greensborough 3088.

Submissions will be considered at the Ordinary Meeting of Council on Monday 29 January 2018 beginning at 7.00pm at 275 Upper Heidelberg Road, Ivanhoe.  Council will consider whether or not to discontinue the ‘road’ and sell the resultant land at a subsequent meeting.

If you wish to be heard at the Council meeting in person, or to be represented by a person specified in the submission, you must state this in your written submission.

If no submissions are received, Council may, at its Ordinary Meeting on Monday 29 January 2018, decide whether or not to discontinue the ‘road’ and sell the resultant land. 

Any person making a written submission under section 223 of the Act is advised that all submissions and personal information in the submission will be handled by Council in accordance with the provisions of the Privacy and Data Protection Act 2014
